As used in these terms and conditions, "SHEIN" , "Company" , "we" , "us" and "our" shall refer to Fashion Choice Pte. Ltd. and its affiliates, and "you" or "your" shall refer to the individual or entity submitting images, designs, text or other content ("Content") to be incorporated into customized products on www.shein.com or purchasing such products. If you wish to purchase customized products on www.shein.com, you must accept these terms and conditions without modification.

BY CLICKING THE 'CUSTOMIZE NOW' BUTTON OR PLACING AN ORDER FOR CUSTOMIZED PRODUCTS, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING BUT NOT LIMITED TO THE SHEIN PRIVACY POLICY, SHEIN TERMS & CONDITIONSAS AMENDED FROM TIME TO TIME.

1. Content: You may submit your own Content or select from a library of designs and images to create customized products. You may only submit Content that complies with the SHEIN TERMS & CONDITIONS, which strictly prohibits pornographic, defamatory, slanderous, harmful, obscene, or racially, ethnically or otherwise objectionable content and applicable laws (including intellectual property laws). We expressly reserve the right to reject any non-compliant material.

2. Grant of License for Your Content: You hereby grant SHEIN, its affiliates and sublicensees (including third parties that provide customized products and related services) (collectively, the "Customization Providers") a worldwide, non-exclusive, royalty-free, perpetual, irrevocable and fully sublicensable right, in connection with the production and purchase of your customized products, to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute and display the Content you submit (including the names and likenesses of any individuals appearing in the Content).

Please note that we will only use your Content for the purpose of providing services to you and fulfilling your customized product orders. We will not use, sell or distribute the Content you have uploaded or any personal information for other unauthorized purposes.

3. Representations, Warranties and Indemnification: You represent and warrant that you have the right to grant the licenses set forth in these terms and conditions; that the use of this Content by the Customization Providers will not infringe, misappropriate or violate any intellectual property rights or harm any individual or entity; and that you will defend, indemnify and hold the Customization Providers harmless from and against any losses, damages, judgments, settlements, costs, interest and any other liabilities (including reasonable attorneys' fees and expenses) related to or arising from any third-party allegation, claim, suit or proceeding ("Claim") to the extent that such Claim is based on a breach of these terms and conditions;

4. No Resale: The resale of customized products, offering or providing customized products to anyone, anywhere, in whole or in part, directly or indirectly, through online or offline channels, is strictly prohibited. The customization service is solely for the purpose of purchasing products for personal use, and you agree not to use the Service for business as a product supplier or for any business or commercial purpose, unless specifically authorized by SHEIN in writing. To avoid potential risks, you may not order more than 10 customized products at one time. And violation of the resale prohibition may result in claims for monetary damages and legal liability against you.

5. SHEIN's Intellectual Property Rights: You may not use SHEIN's intellectual property rights in any way without SHEIN's prior written consent. These terms and conditions and your purchase of customized products do not grant you any rights to such intellectual property (including any photographs, illustrations, graphics, text, designs or images provided to you for customization).

6. Returns: Customized products CANNOT be Returned or Exchanged, except only if we provide an incorrect customized product (for example, you receive a customized product with a pattern that is not from your submission).

7. Amendments: We may amend these terms and conditions at our sole discretion by posting the amended terms on the SHEIN.com website. Your continued purchase of customized products on SHEIN.com after the effective date of the amended terms constitutes your acceptance of the amended terms.
