BY CLICKING THE 'CUSTOMIZE NOW' BUTTON OR PLACING AN ORDER FOR CUSTOMIZED PRODUCTS, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING BUT NOT LIMITED TO THE SHEIN PRIVACY POLICY, SHEIN TERMS & CONDITIONSAS AMENDED FROM TIME TO TIME.
1. Content: You may submit your own Content or choose from the design and image library to create customized products. You may only submit Content that complies with the SHEIN TERMS & CONDITIONS, which strictly prohibit pornographic, defamatory, slanderous, harmful, obscene, or racially, ethnically or otherwise objectionable content and applicable laws (including intellectual property laws). We expressly reserve the right to refuse any non-compliant materials.
2. License Grant for Your Content: You hereby grant SHEIN, its affiliates and sublicensees (including third parties providing customized products and related services)(collectively, "Customization Providers") a worldwide, non-exclusive, royalty-free, perpetual, irrevocable and fully sublicensable right, in connection with the production and purchase of your customized products, to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute and display the Content you submit (including the name and likeness of any individual appearing in the Content).
Please note that we will only use your Content for the purpose of providing services to you and fulfilling your customized product orders. We will not use, sell, or distribute the Content you have uploaded or any personal information for other unauthorized purposes.
3. Representations, Warranties and Indemnification: You represent and warrant that you have the right to grant the licenses set forth in these terms and conditions; that the use of this Content by the Customization Providers will not infringe, misappropriate or violate any intellectual property rights or harm any individual or entity; and that you will defend, indemnify and hold the Customization Providers harmless from and against any losses, damages, judgments, settlements, costs, interest, and any other liabilities (including reasonable attorneys' fees and expenses) related to or arising from any third-party allegations, claims, lawsuits or proceedings ("Claims") to the extent such Claims are based on a breach of these terms and conditions;
4. Resale Prohibited: The resale of customized products, the offering or providing of customized products to anyone, anywhere, in whole or in part, directly or indirectly, through online or offline channels, is strictly prohibited. The customization service is intended solely for the purpose of purchasing products for personal use, and you agree not to use the Service for business activities as a product supplier or for any business or commercial purposes, unless specifically authorized in writing by SHEIN. To avoid potential risks, you may not order more than 10 customized products at a time. And violation of the resale prohibition may result in claims for monetary damages and legal liability against you.
5. SHEIN's Intellectual Property Rights: You may not use SHEIN's intellectual property rights in any form without SHEIN's prior written consent. These terms and conditions and your purchase of customized products do not grant you any rights to such intellectual property (including any photographs, illustrations, graphics, text, designs or images provided to you for customization).
6. Returns: Customized products CANNOT be Returned or Exchanged, except where we provide an incorrect customized product (e.g., you receive a customized product with a pattern that is not from your submission).
7. Modifications: We may modify these terms and conditions at our sole discretion by posting the revised terms on the SHEIN.com website. Your continued purchase of customized products on SHEIN.com after the effective date of the revised terms constitutes your acceptance of the revised terms.
